Mutual respect requires a widespread willingness and ability to articulate our disagreements, to defend them before people with whom we disagree, to discern the difference between respectable and disrespectable disagreement, and to be open to changing our own minds when faced with wellreasoned criticism. ”9 Academic freedom can continue to be robustly protected while equality becomes robustly promoted. Should academic freedom take priority over subjective discomfort? Yes. Should promotion of equality take priority over unfettered expression of whatever may occur to an individual scholar, even when irrelevant to the subject matter, simply because it flows from his or her personal creativity?

The United States has refused to join this part of the convention precisely because the laws necessary in the service of an international convention and international conceptions of equality would be patently unconstitutional under American constitutional doctrine. I could go on to talk somewhat critically and sceptically about my own country’s laws in this regard, but that is a different topic; I only use this example to show why it may be a mistake to look south for guidance on issues of freedom and speech.

More commonly, in many places in the world, this issue might come up in the context of exemptions for academics from what would otherwise be restrictions on freedom of speech.
